GENERAL

 

1-Night Limited (1-Night) sells tickets and products as an agent to the artist, venue, event promoter, bar or restaurant (all Sellers). All claims are the sole responsibility of the Sellers.

 

For certain events, 1-Night is not an agent and only provides the platform for the transaction. Your purchase and contract is made directly with the Seller and there is no contract between the customer and 1-Night. For these certain events the Seller is responsible for all refunds and applicable consumer laws.

 

All advertised prices and billing are in New Zealand Dollars (NZ$).

CONDITIONS OF SALE WITH 1-NIGHT AS AGENT

 

1. No Refunds or Exchanges - Purchases cannot be exchanged or refunded after purchase except in accordance with the applicable laws in the jurisdiction of purchase. 1-Night cannot be held responsible for any tickets which are lost or stolen. 1-Night reserves the right to cancel ticket bookings which it reasonably suspects to have been made fraudulently.

 

2. If Refund Required - If a refund is required by law, then liability is limited to refunding the product price minus all associated charges, booking fees and any other fees which are non-refundable.

 

3. Delivery - Customers must allow adequate time for delivery of tickets. The method of delivery will be via an email within 24 hours of payment being processed. This may either be a confirmation, receipt or e-ticket.

 

4. Customers Responsibility - It is the responsibility of the ticket holder to ascertain whether an event has been cancelled and the date and time of any rearranged event. If an event is cancelled or rescheduled, 1-Night will use reasonable endeavours to notify ticket holders of the cancellation. Please note that we cannot guarantee that ticket holders will be informed of such cancellation before the date of the event.

 

5. Seller's Responsibility - All claims and complaints about the event are the sole responsibility of the Seller.

 

6. Changes to Line-Up, Venue etc - The Seller reserves the right to make changes to the advertised artists, programs, venues, prices and seating arrangements without being obliged to refund monies or exchange tickets.

 

7. Subject to Rules & Regulations - All tickets are issued subject to the Rules and Regulations of the venue, event organiser or promoter. This also includes any rules or regulations imposed by the promoter at the venue including any compulsory payment system that may be used at a festival. Full details are available on request.

 

8. ROAR - The right of admission is reserved should patrons breach any Rules and Regulations of the venue, event organiser or promoter. Rules and Regulations of the venue, event organiser or promoter may include, but are not limited to, personal search, intoxication checks, identification checks and age verification. The management may on occasions have to conduct security searches to ensure the safety of the patrons.

 


 

 

 

CONDITIONS OF SALE WITH SELLER AS AGENT

 

1. Only Apply to Certain Events - These Conditions of Sale with Seller as Agent will apply and supersede all other Conditions of Sale for the following events (this list may be updated at any time):

a. Splore 2012

 

2. No contract with 1-Night - At no point does 1-Night undertake a contract with a consumer. All purchases are made directly with the Seller. 1-Night only provides the platform by which tickets are sold and issued. It remains the Sellers sole responsibility to deliver the event to which the tickets relate and to make good any refunds or compensation to consumers for the failure to deliver the event. All refunds, issues, claims and complaints associated with the event are the sole responsibility of the Seller.

1-NIGHT WRISTBAND (RFID) PAYMENT SYSTEM TERMS & CONDITIONS

 

1. Use is subject to Terms & Conditions

Use of the 1-Night Payment System and 1-Night Payment Wristbands is subject to these Terms & Conditions and any use of the 1-Night Payment System or a 1-Night Payment Wristband shall constitute acceptance of these Terms & Conditions.

 

2. Definitions

1-Night – 1-Night Limited

Payment System – The system operated by 1-Night allowing wristbands to store and spend e-money at an event

Payment Wristband – A wristband capable of storing e-money on the 1-Night Payment System

Event – Any event that uses the 1-Night Payment System

e-money – The electronic balance loaded to a Payment Wristband that can be exchanged for goods and services at an event. E-money is not currency or legal tender.

 

3. Wristband remains the property of 1-Night Ltd

All 1-Night Payment Wristbands remain the sole property of 1-Night at all times. Any misuse of the wristband or breach of the Terms & Conditions may result in the forfeit of your wristband.

 

4. Loading of E-Money to Payment Wristband Constitutes Purchase

The loading of e-money to a payment wristband constitutes a purchase between the customer and 1-Night. E-money is not legal tender or cash. E-money is sold by 1-night for use at the festival it is sold at.

 

5. No liability if lost or stolen

1-Night accepts no responsibility for any lost or stolen wristbands. 1-Night accepts no responsibility for any e-money remaining on lost or stolen wristbands and offers no guarantee or warranty over any e-money lost due to a lost or stolen wristband. If you’re wristband is lost or stolen, so is the e-money.

 

6. Refunds at the Event

Refunds of e-money may be available at the event, during the course of, or at the conclusion of the event. A refund fee, minimum refund amount, or rounding of refund amounts may apply.

 

7. Refunds online after the Event

Refunds of e-money shall be available for 2 calendar months after the event. Any refunds applied for after 2 calendar months after the conclusion of the event will not be processed. A refund fee, transaction fee and/or processing fee shall apply. If the remaining e-money balance on a payment wristband is less than the applicable fees then no refund shall be given. The accuracy of any information provided by the customer in order to process a refund is the responsibility of the customer. 1-Night accepts no responsibility for loss caused by information supplied by the customer.

 

8. E-money Redeemable at One Event Only

Any e-money loaded to a payment wristband at any event can only be redeemed for goods or services at that event. Any e-money remaining on a payment wristband cannot be used at any other event other than the specific event at which the e-money was loaded to the payment wristband.

 

9. Unclaimed E-Money Remains the Property of 1-Night

Any unclaimed e-money remains the property of 1-Night Limited.

 

10. Disputed transactions, refunds and balances

The customer may dispute any transaction, refund, refund amount, or balance of e-money. In order to process a dispute the customer must supply 1-Night with the Payment Wristband in question either in person or by post. Any dispute will be replied to within a reasonable amount of time with a reasonable explanation and a refund if required.

 

11. Terms & Conditions Subject to Change per Event

These Terms & Conditions are subject to change at any time. These Terms & Conditions may also be altered on an event by event basis at any time.

1. Terms of Use - By using the 1-Night.co.nz website you are bound to these terms of use.

 

2. Copyright - The site may only be used for personal and non-commercial use. All information on the website is copyrighted and you cannot make any copies or reproductions.

 

3. Disclaimer - The use of 1-night.co.nz is at your own risk. 1-night provides no warranties for the accuracy of information on the site.

 

 

 

 

1-NIGHT PRIVACY POLICY

 

1. Information We Collect - 1-Night Limited operates the 1-Night.co.nz website. When you use the website we collect two different types of information:

 

a. Your Personal Information: Personally Identifiable Information is collected from you when you sign up for 1-Night or make any purchases. This includes things like your name, email address and other demographic info.

 

b. Aggregated Data: This is data that is collected by our systems about how you use the site, such as where you click, and how long you spent looking around. It is not linked to your personally identifiable information.

3. Who we share this information with - We share your personal information only with the event promoter and venue of the event you have purchased tickets for. They may contact you with important information about the event you have purchased tickets for. For all other contact the organisers can only contact you if you have given express approval and if they abide by all applicable laws. By law you can opt out of any email contact at ay time. Your aggregated data information may be shared with third parties but the aggregated data will never be able to personally identify you.

 

4. What else we do with your Information - We use your information for identity, especially with credit card payments, for contact about our services, for marketing and other uses where we have your permission.

 

5. Opting In and Out - We will always give you the option to opt out of our contact with you.

 

6. Right to Access your Info - You always have the right to access, correct or delete your personal information.
